My question involves a marriage in the state of: Arizona. I have been divorced for 2 years now. All of our 401K was in my ex-wife's plan because her company had the best retirement plan. When we divorced 2 years ago, it was understood that since AZ is a community law state, I would get 1/2 minus an outstanding loan balance. She and her family's family law attorney have been fighting me for the last 2 years in giving me that 1/2 of my retirement plan. Unfortunately, I didn't have the financial means to hire a family attorney and so I agreed to a final divorce decree drafted by her attorney which was deceitfully drafted to allow this delay in submitting a QDRO to the court. I hired a QDRO lawyer about a year and half ago believing that it was probably going to cost me $1 - $2K to get this approved, but now $5K later, still no progress and even though we came to an agreement allowing her to take more $ out of my 1/2 of the 401K proceeds and it has been approved by the Plan's lawyers, they still refuse to sign off on the Plan-approved QDRO and return to my QDRO lawyers because told us a couple months ago that "he's found some irregularities" in the Plan-approved QDRO, yet he contemptuously refuses to tell us what those irregularities are. Now, the court has said that they are going to cancel the, our case will be dismissed in a couple weeks. I was going to have my QDRO attorney's lodge the QDRO, but they said that they would need a $2K retainer to do thi so I'm going to lodge it myself. I just need to know where to get the forms to lodge this QDRO myself; otherwise, who knows when I'm going to get this money. Thanks for any assistance...
