    Default I Lied to My Insurance but Want to Tell Truth

    My question involves an injury that occurred in the state of: California ok nobody was injured but this is what happend my husband left in my rental in the morning to take my sons to school he does not have a license but is on my personal car insurance he should not have been driving my rental he was not on the contract he was driving north on a one lane street but at the intersection he was aproching cars stay on left side either to turn left or go straight and merge to the right to turn right he got over to the right not knowing the car two cars up let a car going south turn into there drive way him on the right side did not see the car turning into drive way so he hit her he got put asked if she had a license she said no and asked if the cops could not be called he took her information and came back home to get me told me what she said and that he didnt understand she only spoke little English so since I speak Spanish I left to see what happenend when I got there she told ms what happened and since I had a license I asked if we could say I was driving I took the car to the rental location and wiggled a form that I had the accident, and called my insurance and lied to them and made a claim I lied to them also I haven't heard from her insurance and my insurance guy is out for a week so I don't know who to tell the truth. Also she told my husband when this happened she did not have a license ether but didn't tell me I didn't know until I got home and told my husband I said it was me before my insurance guy left he did tell me that from what I told him happened I was not at fault can I got to jail I've never lied and am sick that lied I am also 4 months pregnant so this stress and not eating is killing me but I really want to tell the truth before I talk to her insurance what can I do can I go to jail? How do I tell my insurance ? Will my husband go to jail he is the sole provider to our family we have 4 kids with one on way

    They may just deny the claim. Was this reported to the DMV? We're not lawyers here, so you may want to ask an online insurance lawyer about this.

    No it was not reported to DMV and how would I find an insurance lawyer I'm sorry this Is my first time ever on this sight can I find one here I'm not sure what a misadmeter is does that mean I go to jail

    Technically, you attempted to commit insurance fraud. They may or may not prosecute. See CA Penal Code section 550. You could be giving up your nursing bra for a jumpsuit, for a few years.

    When you make a false claim for insurance, that is a criminal offense.

    One approach would be to contact your insurance company and tell them that you're withdrawing the claim, nothing more. Should you choose such an approach, don't volunteer any explanation or statements as to why you're dropping the claim. They'll figure it out, but you don't have to say the words. Better, particularly gived the apparent language issues and the false claim, would be to retain a lawyer to help you with the issue.

    John, when you don't know what you're talking about you should simply leave a question alone. You're not a lawyer, no doubt about that, but that's no excuse to post in ignorance.

    I would look for a criminal defense lawyer. The insurance issue is not complicated, and it's the criminal aspect that's worrisome.

    Criminal defense does that mean I can go to jail? I don't have money and if I drop my claim what happens to the other persons car since it was damaged and not driveable my insurance said it was her fault how I described the accident

    You need to talk to a REAL lawyer, there are many online who can better answer you. It was a rental? What are you going to tell the rental car company?
