    Default How Much Could Child Support Be

    My question involves child support in the State of: florida..

    presently have 50/50 custody aggreement...have not had mediation yet...

    my question is....I make more income than soon to be ex...she walked out of the family home which I would like to keep for the sake of whats left of the family

    she said in the beginning that she does not want alimony...paperwork says otherwise
    I am just stressed that they can make me pay child support and alimony and it could
    get to a point that I will not be able to afford the mortgage...

    not sure if that is a statement or question....sorry...

    married for 12 years...she moved out day aftter 12th anniversary...( btw...she gave me an anniversary card and a gift card to a restaurant I like the night before...shows how wacked she is )..... cs calulator asks who is custodial/non-custodial...how is that determined?....child spends 50/50 with each parent...but I am in the family home which is zoned for the school he has been going to since kindergarten were as the rental property she chose to rent is not far but not in his present school zone...

    12 years might - MIGHT - entitle her to alimony.

    Is there a huge difference in your respective salaries?

    mine pretty much doubles her's.....also....don't know if this has anything to do with anything,,,but she has a live in boyfriend/roomate whom pays the rent and she pays the other household expenses...

    It's not income; it is an entirely discretionary gift given to her by her boyfriend that he could stop any time he wants to because he is not obligated to gift it to her in the first place. Nothing in the florida child support guidelines reduces a parent's child support obligation because the other parent is receiving gifts from a non-spouse.

    That could and often does happen. Happened to my sister and one of my best friends, too. Both had to sell the family home and sell it in a down market, too, because they weren't able to keep their homes based on their incomes and on what they received in child support and alimony. Reverse situation I know, but in their case, the man moved out. It was only the combined incomes of the couple that allowed them to afford their homes in the first place. Once the man moved out, even with child support and alimony and their own incomes, they couldn't afford it.

    IME, it is the usual situation unless you have a high earning spouse or live in a house that was less than you could have afforded as a couple to begin with. Most people I know live in a house that is commensurate with the couple's income and when the couple splits, the house usually has to be sold.

    the house is upside down by about 90k..... I can afford the mtg. the way things are now....but if I have to pay 300 to 500 a month to her so she can live in a rental schack that did not even come with a washer or dryer and loose the house our children have called home for the past 7 or 8 years... is just stupidity.....

    I understand but the reality is that most couples can afford their mortgage as long as they are together but when they separate, neither can afford the home by themselves due to either paying child support or not receiving enough in child support.

    Florida....Considering Adultery in Alimony Awards

    First it is important to consider the words “MAY consider”. This implies that the Court has discretion in this area. In considering the adultery, the Court will generally look to see if there was detriment to the non-adulterous spouse.

    Generally Courts in Florida have interpreted this to mean that there has been a financial detriment to the non-adulterous spouse. For example, if the adulterous spouse took his or her girlfriend or boyfriend on vacations, bought them jewelry and paid for an apartment for the girlfriend or boyfriend, these would cause financial detriment to the non-adulterous spouse as marital assets that could have been used for the benefit of the marriage have been wasted or dissipated for non-marital purposes.

    It is important to note that using marital funds to keep the Marital Home in tact (ie. to pay the mortgage, keep the home in good repair, etc.) in the event that one spouse moves out is not considered dissipation.
