    Default Landlord and Rental Agent Harassing Me with No Just Cause

    My question involves civil rights in the State of: NY


    Please help me. I need information. My landlord and his rental agent are both harassing me horribly by making false claims against me. They even went so far as to send me a letter giving me a final notice of eviction warning, stating that if they get one more complaint against me, I will be evicted.

    I am 61, physically disabled and I know that because of their neglect against me that I have been experiencing since I first moved into my lovely apartment in August of 2011, they will not renew my lease.

    I am quiet, clean and extremely considerate of my neighbors at all times. I live above a very mean, elderly couple who have done nothing but lie to the landlord about me harassing them when in fact, it is them who have been harassing me terribly since my move in date.

    I was only here for 3 weeks when my landlord called me and told me that he had received a complaint about me stating that I was throwing trash from my bathroom window. I was shocked when he told me this and my reply was, "I would never do such a foolish thing, I am a very clean person." His reply to me was, "Well, just don't do it anymore."

    In December of 2011, as I was walking down the stairs to retrieve my mail, the 6 ft tall elderly man viciously turned to me and stated, "You're a god damned bum!" I was terribly frightened by his violent action.

    In January of 2012, while in the presence of my 24 year old grandaughter and her friend, the elderly man physically lunged at me screaming foul language. My grandaughter told him to get away from me, (we were going into my storage unit in the basement) Suddenly the crazed man lunged at her and yelled at her while still using foul language yelling, "You tell your god damned grandmother to stop causing trouble for me!" I was shocked. I had only called the office one time in the past due to their horrible booming and banging all throughout the days, which the rental agent replied telling me that they could make as much noise as they want, from 7 am to 10 pm.

    The letter that was sent to me by my landlord and his rental manager now tells me that the elderly couple below me told him that I called him an asshole, when in fact, I would never call another human being a foul name.

    I don't know what to do. I can't move as the last move nearly killed me. I am completely innocent of my landlord's charges and the elderly couple's lies. And, my landlord told me recently, "If anyone goes, it won't be them, they've been here for 17 years." Yet, he breaks his own lease and allows another tenant to abuse and assault me, over and over?

    Please tell me what to do? I contacted Senator Kirsten Gillibrand, but I have not heard from her as of yet. And, I contacted Housing Authority here.

    A few letters sent since August of 2011 are not going to be considered "harrassment" by any means. And if you believe you are being assaulted and are getting no help from the landlord, you could always consider contacting the police over this matter. You are likely to get a quicker response from them as opposed to your Senator.

    At any rate, a landlord cannot evict anyone. Only a court can grant an actual eviction. If it comes to this, there will be a court hearing where you will be able to tell your side of the story. The court will then decide whether to grant the request for the actual eviction or not. If they do grant the landlords request, you would have to leave.

    This does not, of course, mean that the landlord/management will not renew your lease when it is time for them to do so. It is their option not to do this and it is understandable that they would very likely prefer to keep a tenant who has been there for 17 years. While it would be difficult to move it does sound as if you have family to help you do so and perhaps finding a different place would bring you a more peaceful place to live without crazy neighbors to deal with.

    Gail is very smart and knowledgeable.

    I would be planning to move at the end of my lease. I'm sure your granddaughter and other relatives can help you.

    A few letters? They sent me only one warning letter. And, that was wrong of them to do that, when I have done nothing wrong. I don't know who you are, but I suspect that you are NOT an attorney and if you are, then maybe you should NOT be! In my lease, it states that no tenant is allowed to harass another tenant and this is exactly what this man has been doing to me since I moved in. It doesn't matter how long they have lived in their apartment, they are not exempt from the lease in any way,shape, or form. They must abide by our lease, period. If the landlord does not even support his own lease, then maybe it's time an investigation took place into this landlord and his rental agent, especially if they are renting to people who are on HUD/Section 8. In order for a person to receive Section 8, you MUST have a clean background and be a good tenant, which I am and always have been. This landlord has not only violated his own lease, but he has subjected me to scrutiny from HUD/Section 8 and I will not stand for this!

    Why should I be forced to move from my lovely apartment just because another tenant does not like me? There should be a law that protects HUD/Section 8, the elderly and the disabled from having to suffer at the hands of unprofessional landlords/rental agents, period! Do you honestly think that I will simply bow to this horrendous, criminal activity just because YOU think I should? This forum is a joke! I truly thought that a member could get good, legal advice, your reply to me is wrong. I could find better advice on You Tube, Gail!

    Sigh, you do not seem to understand the law. What is your current lease term? If you have not resigned a 6 month or 1 year lease, you are a month to month tenant and can be evicted, with proper notice, on that basis. Whether you are a nice little old lady or a shrew is irrelevant to your legal status.

    Then this is even less evidence of harrassment.

    The landlord has not violated his own lease. He has responded to a complaint from another tenant; just as he responded to your complaint you provided regarding this man.

    Honey, I don't really care what you do (and, since I'm 61 years old too, I find your comment about being "elderly" at that age fairly offensive). If you wish to remain in this situation and suffer with this crazy neighbor, it's your choice. Just remember that management does have the legal right not to renew your lease should they chose this route.

    Just because we didn't provide you with the information you wanted does not mean it isn't legally accurate.
