    Default Reduction in Work Schedule for an Exempt Employee

    My question involves employment and labor law for the state of: South Carolina

    My employer recently sent out the following notification: “We have decided to implement reduced work schedules. Employees impacted by this decision will be placed on 32-hour work schedules with corresponding adjustments in pay.” What is the policy for exempt employees if more than 32 hours are worked in one week? I currently work more than 40 hours a week to do my job now at full salary. Today HR told me that there is no change in pay above the 32 hours, so it seems to me that I will be expected to maintain my same productivity (and beyond 40 hours of work) for a 20% reduction in pay even though they are claiming a 32-hour work schedule.

    They have worded it incorrectly. What they've done is cut your pay but not your workload. This is perfectly legal. (Unfortunately.)

    For an exempt employee, hours worked is immaterial. You are paid to get the job done, and the salary covers all hours worked, no matter how many or how few.
