    Default Caught for Shoplifting at Safeway

    Caught for shoplifting and item(less that $10) at Safeway by undercover security. I feel bad, etc... like everyone else. I gave them my address, driver's licence, refused to give SSN. I got a letter in the mail 2 months later from Safeway's lawyers saying they wanted me to pay $300 money order, check, or credit card payable to SAFEWAY, and avoid a civil suit.

    Then at the bottom it says:

    IMPORTANT NOTICE: The payment of any demand made upon you does not prevent criminal prosecution under a related criminal statute provision. Payment of the amount demanded may not be used in any court proceedings as an admission of liability.

    So my questions are:

    1. Does anyone have experience with these cases and is there any way I can ask them to pay $200 or something less than $300 since the item i took was only like $5.

    2. I am a 20 year old college student and obviously want a clean record. Since it is a civil settlement nothing will go on my record, but should I be worried about the IMPORTANT NOTICE??

    I work on Loss Prevention field and can answer your questions

    So my questions are:

    Answer: No you cannot however what you can do is ofer a payment arrangement. Thsi money is called Civil Recovery and the $300.00 is about average amount. If you dont pay you could be sued for much more and you dont want that. Just make a payment plan.

    Answer: "Important Notice" is like and other debt collection notice however it will effect your credit if not paid. Thsi Civil Recovery is outside of court. If you have a court date your fines and penatlies will be told then so this isnt over yet.

    The letter asks for the money and says:

    Otherwise, if we do not receive payment within 15 days from the date of this letter, my client may hire local counsel to take all necessary legal steps which include a civil action in court to collect the full amount allowed by the statute.

    panther, or anyone else with experience.... Does this mean if I pay the $300 within the next couple of days I should be done with this whole situation?? No court, no record, etc?

    They always demand payment right away call them and offer a payment arrangement.

    In all my years in Loss Prevention NEVER has a demand of Civil recovery refused a payment plan!

    I got caught shoplifting at safeway too... its my first time being caught, i am 16. the amount was around 48$ and they took down my name, address, ss#, and made me sign a notice that i was going to recieve a bill around five hundred dollars? NO COPS WE'RE CALLED. an undercover shopper caught me.

    my 22 year old sister checked me out, THEY TOOK DOWN HER DRIVERS LICENSE NUMBER.

    On the 2 forms with my contact details, my adress and ss# ARE FAKE, they have my real name because i gave them my school ID. I PANICKED, and lied.

    Im just panicked that more consequences will happen and i will be recieving more than just a bill.... once they track my sister down

    DO YOU think they will try to find me and track me down through my sisters drivers license number? Will we get into more trouble? What would happen to my sister.
