My question involves criminal law for the state of: New York
I was recently arrested for shoplifting about $90 worth or merchandise from Sears. I am 20 years old and this is my first offence. I was given a DAT (Desk Appearance Ticket) and am required to appear in court. While I have already learned a lesson from this ordeal I am afraid that I have learned it too late as I am now facing criminal charges. I am doing my best to obtain any information about what I should expect for the trial as well as my future. My questions are:
1. How would a obtain a public defender? I have been unemployed for over a year and have no money to even pay a fine let alone pay for legal council so I am afraid I have very few options.
2. How should I approach these charges? I have read about diversion programs and was wonder what would be available/how could I obtain one.
3. If I was eligible for a diversion program, on public record would I appear as guilty until probation is over?
4. If I participate in a diversion program, after it is completed and the record sealed, will that show up in a background check?
I am really hoping I can put this entire incident behind me as I realize it was a mistake, are there any ways I can prevent this from having a significant impact on my future?
I appreciate any help given as well as any criticism. I realize I cannot undo the mistake I have made, I now only wish to put it behind me and be able to move on with my life.
