    Default Cause of action against third parties?

    Does a spouse in the state of Georgia have a cause of action against someone who intentionally tries to break up a marriage?

    1) A third party who intentionally works to seduce the husband or wife with full knowledge that the spouse is married.

    2) A third party who aids and abets the party who is seducing the above.

    If so, what is the cause of action? What would you have to prove? Are there time limits? What typically are the awards?

    Default Georgia - Alienation of Affection

    Georgia has passed the following statute:
    Quote Quoting Georgia Code, Section 51-1-17
    Adultery, alienation of affections, or criminal conversation with a wife or husband shall not give a right of action to the person´s spouse. Rights of action for adultery, alienation of affections, or criminal conversation are abolished.

    Would I have a cause of action under "intentional infliction of emotional distress?" I was so depressed over what they were doing my performance tanked and I lost a six-figure job. I'm still in counseling for depression. I'm over 50 and have been sending out resumes but it's a lot harder to find a job at this age. If so what would I have to prove and are there any time limits? Could both parties be included in the action?

    There's a chance that I will move to North Carolina. If I do that, could I sue for Alienation and/or Criminal Conversation in NC even if the parties live in GA?

    Default Alienation of Affection

    It is unlikely that any such claim would survive the statutory elimination of alienation of affection actions. Your subsequent move to another state would not give you a cause of action under that state's laws for prior events which occrred in a different state.
