My question involves collection proceedings in the State of: New Jersey. I moved to New Jersey in 2012 from Florida. I received a summons last week 03/05/13, from Calvary Collections. I started the debt in 2006 in Florida for living expenses since I was and still am unemployed. I know the SOL for Florida is 4 and 5 years. And the SOL for NJ is 6 years. Since I am now live in NJ, would the SOL be for the state I am living in now or in the state it was started in? I am unable to pay the whole debt or even consider paying back the debt for just the one credit card by living off unemployment. I did mention to all the collectors I have spoke to in the past that I would make arrangements to pay back the debt once I have a stable full time job. I have also written to the credit card companies of my status of being unemployed. Most of them have honored the letter.
I just felt that the collectors on the phone demand payment and won't accept anything else. I kept getting collection letters from several different agencies for the same account and amount. Who was I to pay, if I could, since they were for the same account and amount. I would appreciate any advice you can offer me about this matter. I am considering going the bankruptcy route, but I am afraid of the long term affect. I would like very much any advice in regards to the SOL question for both states.
