I have been divorced now over 4 years. I moved to Florida from Ct with my daughter and son before the divorce. I filed for divorce here in FL while my ex-husband lives in CT. Child support was decided and was taken out of his pay thru Florida courts.
My son turned 18 2 years ago. My ex-husband took me to court here in Fl to reduce child sipport since my son was now 18. Unfortunately I had just been laid off from my job and on unemployment comp. The courts based the child supporrt on what I WAS making, but gave me 3 months to find a job before the reduction. The judge said that is what I was capable of making so he said I will make that again.
I did find a job but it was difficult and went beyond the additional 3 months. I drained savings etc. I did find a job full time with benefits but pay is considerably lower by almost half than what I used to make. I was previously a restaurant manager working over 55 hours with no benefits. Now I only work 40 hours with benefits, but as I stated, income dropped.
I helped my ex-husband thru school so he could get his masters degree in social work. The deal was then I go to school. He left me for another woman 2 months before he graduated and I never got to go to school.
He is a director at his company and receives raises since the new order drawn up 2 years ago. My income went down and my mortgage, ins and everything else went up.
I am considering getting a part time job to make ends meet, but will have to work 60 hours or so to make it. I have a 12 year old who is on sports, etc and needs me available. Adding hours will possibly harm her well being.
Do you think I can take my ex back to court to revise the cs? Do I have a case? He tells me all the time he is broke but I think it is a cover.
