    Default Sex Offender Registration Requirement for Convictions Below Age 18

    My question involves criminal law for the state of:
    TEXAS

    At age 18 D was accused of committing indencency with minor when he was 17. He was tried as an adult and as if now is still in jail and currently must be on the SO list for life. Despite the fact that the accusations were false, he was scared into guilty plea, and an ongoing family fued that caused the accusations to be made.....he was 17 at the time if alleged act. If tried as minor he would of been removed from registry at 18. THIS was plotted by those who accused him...is this legal? Can it be overturned ? Can he EVER be removed from SO registry???? HELP!!!!

    Was the child at least fifteen years old?

    No. The minor child involved in the accusation was under 15. Sorry for the delayed response...internet issues.

    There's the rub. He already stood in front of a judge and PLED GUILTY. That's not the result of a plot, that's a conscious decision that he and he alone made. Yes, had he been tried as a juvenile, removal would be a different issue - but he wasn't - he was tried as an adult, was entitled to counsel and STILL admitted in open court to some level of the charge against him, rather than forcing the state to take the case to trial and PROVE the charges against him. Can it be overturned? Not likely...but that's something he's going to have to get evaluated by a skilled defense attorney after that attorney has had a chance to review all the evidence and the transcript of his proceedings. And he has a very limited window where the court would even consider an appeal - so he needs to be retaining that attorney ASAP, else yes, he's looking at lifetime registration.

    Texas provides a process for petitioning a court for early termination of the sex offender registration requirement, in the Code of Criminal Procedure, starting at Sec. 62.404.
