    Default Accused of Battery with a Weapon, With Eyewitness Testimony, How to Defend

    My question involves criminal law for the state of: CA

    i was charged with assault and assault with a weapon. I have records saying i'm mentallly unstable and violent. I think that's what convinced the police that I could have been involved. I wasn't there when the supposed incident happened. I was just in my room, feeling depressed and I didn't wanna talk to anyone and unfortunately nobody could back me up and say I never left the house. When my charges were read in court, they believe me to be bipolar, schizophrenic and have multiple personalities..

    The "victim" sustained cuts and bruises during the incident and her family claimed to have witnessed me hurting her. Well I think that's the crazy part. Did she purposely hurt herself to destroy me?!

    I am feeling so helpless... Are there any odds that I can win this?

    You do not have to prove anything. The state has to prove beyond a reasonable doubt that you committed the offense. However, if they have witnesses that saw you attacking her, then their case may be pretty strong. Are you subject to blackouts or periods of disassociation as a result of your illness?
