    Default Hitting a Car While Turning Left

    My question involves an accident occurred in the state of: Virginia

    I was leaving the parking lot and about to make a left turn, a car (Car 5) decided to try to get by me from behind and get in front of me to my right. Car 5 blocked off my line of sight partially. I proceeded to look both ways and then turn left onto the main road and I hit a car (Car 3) that was speeding and managed to get in front of me, I hit that person in the back left of the car, damaging my front right and his back left. We talked and tried to exchange information, I have no insurance and they allegedly talked to their insurance company. I gave them my name and number, but when I asked for theirs, they refused to give me their information completely, they were very unprofessional and I am skeptical they were doing something wrong. I was partially in the road before Car 3 even showed up, what I am thinking is that because I was already in the road, Car 3 would have been able to safely slow down and I would have been able to get into the road safely. The weather was pretty bad, there was a couple of inches of snow during the morning so the road was all wet by the time it happened. What I want to know is if I really am at fault and if I am, is there a possible loophole I can exploit or use to get out of paying fines/being sued. I'm glad everyone is ok, I just cannot afford to pay for any damages, they said that their insurance would be able to cover them and my car.

    Indeed... And that is the good part.

    The unfortunate part for you is based on your description of what transpired, and regardless of the weather, you clearly failed to yield the right of way and so no matter how you you slice it, you will likely find yourself responsible for repairs on both cars. The other driver can obviously get his car repaired, his insurer will pay for the cost and come after you for reimbursement.

    Unfortunately, it does not work that way... The decision to cover your damages is not up to him. It is his insurer's decision and since he is not likely to be found at fault, he is not liable to you for your damages.

    Also should keep in mind that if you do end up getting sued by the other driver's insurer, and if you lose and if they get a judgment against you, Virginia law requires the DMV to suspend your license until you satisfy the judgment.

    This is pursuant to § 46.2-417. Suspension for failure to satisfy motor vehicle accident judgment; exceptions; insurance in liquidated company; insurer obligated to pay judgment.

    Would I possibly be able to get out of it if he had a suspended license or no license at all? Using the "he had no reason to be on the road" "why was he driving"?He had levi stickers on his driver window and he seemed to not have his license.

    The status of the other driver is not relevant to your involvement. You caused the crash, therefore you are at fault.

    The "he had no reason to be on the road" contention could also apply to you. He could argue that you were uninsured, therefore you should not have been on the road.

    You have not indicated car 3 bears any liability. Based on your description you are completely at fault.
