    Default Sentencing for a New Crime While On Parole with Misdemeanor Charges

    My question involves criminal law for the state of Colorado: ok so my boyfriend is currently incarserated with DOC here in colorado on a technical parole violation which hes scheduled for mandatory release on March 21 2013...hes will have served 6 months for his violation...however...he sent in a guilty plea for a small misdemeanor theft while he was in jail this time for a charge not related to his original parole or recent violation...however he got caught up on this charge while he was out on parole and not in jail already.....right now he had to send in for a WRIT to have a hearing with the judge because he got arrested on his violation just days before court for this new charge and they issued a bench warrent since they didn't come pick him up for court...his hearing is this coming Monday the 8th and I'm sure they will drop the warrent since he is appearing in court however what I'm concerened with is will they give him time served for this....or will they sentence him for more time.....will he have to wait and see the parole board again to find out??? will he be able to still come home and will he have to go back to jail again??? How does this all work??? His original parole has a MRD of Febuary of 2014 so hes on the back end of his sentance....and doesn't he get time served for things as well?? Also none of his charges were violent...he went to DOC for a felony theft 6 or so years ago and has been out on parole with some violations.

    Based on his history and the fact he could not even complete parole without stealing again, he is likely to get jail time again. It seems to be the most beneficial thing to the public.

    The court has broad discretion as to whether the sentence should be consecutive or concurrent, based upon such factors as the nature and circumstances of the offense, the defendant’s appreciation of and attitude toward the offense, the defendant’s character, and the defendant’s amenability to rehabilitation. See Penal Code, Sec. 669.
