    Default First Time Offender Petty Theft

    My question involves criminal law for the state of: Florida

    I'm 24 and made an incredibly stupid decision and tried to shop lift a pair or shoes that were $71.00. They brought me in the back and I returned the merchandise. They called an officer and he gave me a citation to appear in court. He told me I wasn't going to be arrested on the spot or even when I go to court otherwise he would have already did it. He also told me that since this is my first offense and have no record the judge should go easy on me. I was told by a employee that worked at the store that there was something I could say to the judge that could keep this off my record but I was so upset and distraught that I honestly don't remember what it was. Is it a diversion I need to ask for? Or is there another term?

    I can't afford a lawyer and I'm not sure if it is necessary for me to try to obtain one or not. I've never been in any kind of trouble before so I'm not sure what to do. Is it likely that I will have to do some time in jail? Or will it be more likely that I will have to pay fines and have community service etc? I would just like to get as much information as possible and leave this horrible mistake behind me. Any information or advice any of you can give me would be very appreciated.

    You will want to see what information is on the court's and prosecutor's websites about diversion or deferral (and whether, at your age, you would qualify), and if you don't get answers you deem sufficient - or just because it's the sensible thing to do - consult a local criminal defense lawyer to learn about likely outcomes given the court, prosecutor's policies, your age and the facts. You may be able to avoid a criminal conviction, but we're not in a position to make promises. You can check with the court to see if you qualify for a court-appointed lawyer.
