    Unhappy Chapter 7, Mistake on Forms

    I used a service to prepare my chapter 7 filing. On the schedule of statement of financial affairs, the service said not to put anything in this area, when it asked if the debtor was a party to any lawsuits. The notes said this had no bearing on the outcome of the case, and to put something in there could only cause delays in discharging. I have a judgement and a pending suit against me that I will probably loose. My question is should I have listed these there and should I file an ammended form. I only filed 15 days ago so I do have time to ammend. Thanks.

    They are correct that declaring a pending suit could delay the resolution of the bankruptcy, but entirely incorrect to tell you to leave it off if you want to benefit from the automatic stay in the lawsuit, and if you want the obligation underlying the lawsuit discharged. (Not every claim is dischargeable.) If I were you I would seek to amend.
