Default Customer Didn't Pay Balance of Room Rental Fee - Can He Be Charged With Theft

My question involves criminal law for the state of: Virginia

A man person rented a party room at my facility for his birthday party. He secured it with $50 deposit. At the end of night the balance was $200. He tried his credit card but was invalid. I allowed him to go to his house with a promise to return. I told them I would call police if he didn't return. The person never returned. Is this considered theft of service? Can I pursue criminal charges to get my balance?

You should expect that the police will tell you that it's a "civil matter".
