    Default Roommate Stopped Paying Rent and Moved Out

    My question involves landlord-tenant law in the State of: Minnesota

    I use this apartment for work and I'm rarely there. Basiclly it's my office that I spend the night in once a week. I let a woman and her 2 children move into it with me on December 26th. We agreed that she would pay me $245 a month for rent. She is not on the lease. I thought she filled out the rental application right away so we could move into a larger apartment, but she did not. She paid me late in January 21st for her share of Januarys rent. She waited 6 weeks before she filled it out and then she was turned down. She was then asked to leave by the building manager. In Feburary she promised to pay on Feb 5th. She was in a car accident and now thinks she doesn't have to pay. I asked her to pay on the 15th. She told me she was moving out, and did so. She only took a few things out of the apartment. She has asked me for money, emailed me about her problems, overloaded me with her drama and so on. On the 15th she still did not have the money. I explained to her I needed the rent money and to leave it on the counter for me to pick up on the 18th. When I arrived there on the 21st the money was still not there. I text'd her and asked her where the money was. She did not have an answer for me. She did not tell me. I told her if she didn't bring me the money I would have the lock changed. She didn't bring the money that night so I changed the lock the next day, on the 22. I told her to have the money by the 28th or I would have to donate the remainder of her items.

    She is not on my lease with the building. She verbally agreed to our roommate agreement which states that she would pay $245 a month rent by the first of the month, or pay a $95. late fee. It also states that she would give me a 30 day notice before moving out. But I realize she didn't have managements approval to move in. Her belongings are still in my locked apartment. Which she doesn't have the key for. I just want the back rent for and the late fee of $95. and the lock change fee of $50 How can we resolve this issue? Can anyone help us? Thanks!

    Quite frankly, I think you need to drop your goal of getting any back rent from this person and be glad that you aren't being evicted yourself for allowing an unauthorized person and her two children to move into the apartment.

    This woman has no money and it's unlikely she'll have any in the near future. Just cut your losses with this one.
