    Default Division of Medical Bills Not Covered by Insurance

    My question involves child support in the State of: Nevada

    I want to start with a little background info. I have a child support order that states that we will both carry ins and spit the medical costs not covered by ins. My daughter has been struggling in school for years. When she was in elementary school her teachers were great and helped her. Once she hit middle chool the support dropped. The teachers have told me that it is her responsibility to do such and such. She has a lot of problems with attention, and she is slow at learning. When I talked to her Dr. he suggested contacting the school for testing.

    I contacted her school and was told that the school psychologist didn't do the testing. The school said they would let the psychologist know and he would contact me. After 2 weeks of waiting for a response and having teachers and counselors trying to contact him I gave up. I looked at our insurance policies and realized that my ins didn't cover any of the testing and his insurance would cover it as long as the Dr was on their plan. I began calling the Drs that were listed on the plan, only to find out that none of them did the testing that we needed. So, I ended up making an appointment with a Dr that did the testing and knew we'd have to pay the full amount. I gave him advance notice about what was going on and how much it would cost and even got his permission to have the testing done. Most of our contact is through texts. However, when it comes to money he says that he didn't get the message. I have copies of the tests that I send him but the resposes have been verbal when I bring it up at pick up/drop off.

    About 2 weeks before the appointment he started started avoiding the Drs phone calls to set up a payment plan. A week before the appt I talked to him about it and he said that he couln't afford it without taking from his other kids. (he has 3 other kids and 2 or 3 forster kids) I couldn't change the appointment because I had to give a months notice to get the vacation time and wouldn't be able to get those days back.

    I guess what I'm asking is do I go to family court or regular court to get the money. I ended up having to pay the full amount on my credit card. Can I request the money plus interest?? Should I print out the text messages and get statements from the people that were trying to help me get in touch with the school psychologist?? Thanks for the help and sorry for rambling on.

    You can request that he be ordered to pay half of the medical bill. You should not expect that the court will order that he pay any portion of your financing costs.

    It helps that he agreed that the testing was necessary, but I expect he'll argue that you didn't inform him that it was not covered by insurance or what the cost would be, and that he would have explored other options had you done so. We don't know anything about the tests or the results - it would be highly unusual for a school to be unable to perform testing necessary to diagnose learning disabilities - so it's not really possible for us to comment on how a court will respond to the argument that the tests were necessary and that no less costly alternatives were available.
