    Default Can You Sue the Attorney for the Trustee for Billing the Trust

    My question involves estate proceedings in the state of: California

    We have a law that says attorney for trustee may be sued for damage to beneficiaries' interest in a trust. In a seperate civil suit against the attorney for trustee, can attorney keep billing/burning the beneficaries' trust money?

    No, you can't (successfully) sue the trustee's lawyer for billing for his work.

    The "work" did not benefit the trust. It benefited his client, the trustee who was not doing his job. If his attorney "billed" the trust, and the benefiicaries want this trust distributed once and for all, we can sue the attorney for draining our trust dry. What we would like to know is, can he still bill the trust if he is not working for the trustee anymore? In other words, if we sue the attorney, how is it he has the right to attach our trust burning it in fees? It's the reason why we are suing. If we surcharge the trustee, his attorney will bleed the trust dry fighting with us (using our money in the trust to fight us with) and we seek to preserve the trust. How can attorneys just latch onto a trust and bleed it? it's wrong to do that. The money was left to the beneficiaries, not this attorney.

    If you think you know all the answers, off with you to file your frivolous suit and get slapped down by the judge.

    If you disagree with disbursements made by the trustee, challenge them in the trust litigation.
