    Default Domestic Simple Battery and Domestic Child Abuse Without Great Bodily Harm

    My question involves criminal law for the state of: Florida

    I was recently arrested and charged. Victims are my wife (nudged her) and oldest son (5, I grabbed his arm to bring him inside the house). I have a No Contact Order with whole family (3 kids) and I am on SOR. Had my 2nd visit today and passed drug & alcohol tests. I have spoken to my wife and she is fine. She wants me home with her and our kids but my court date isn't for another 6 weeks. I was intoxicated the night of arrest and have since enrolled in a 32 week, 12 Step Program for addiction and overall well being as I feel drinking isn't worth it anymore and want to improve my self as a whole. I had contact wth DCF and they were happy about my enrollment and have a meeting with them this Friday that I am actually looking forward to. DCF has already met with the family. I already volunteered for marraige therapy through DCF upon release of the No Contact Order.
    What am I to do? My wife wants me home. I cannot afford an attorney.

    You spoke to your wife while the no contact order was in place?

    A no contact order doesn't get put into place for nudging your wife and grabbing your child's arm. I think that you are in denial a bit. In any case, unless you want to risk DCF removing the children from your wife, you need to make sure that you have NO contact with her until or unless such contact is approved by DCF.

    Sorry I wasn't more thorough. The No Contact Order has an exception that I can speak to my wife by phone.
