My question involves paternity law for the State of: Virginia/Texas
Ok this is the situation .. Eight years ago a son was born. He was a child brought to this world as a cause of rape so as you can assume the bio father is not in the picture nor is he aware of the child. When he was three years old the mother met somebody that appeared to be a "knight in shining armor." He wanted to open his arms to the son as his own. Being that the Birth Certificate "father" section was still blank they just wrote his name in and turned it in knowing that he was not the biological father. Realizing the mistake that she had made 5 years later after a terrible abusive relationship of being yelled at and hit for half a decade she finally stands up for herself and gets a divorce but is now wondering what she has to do in order to get his name off the birth certificate. She originally did it thinking that was the proper procedure and now is afraid of him having any rights to the child due to his extensive anger issues in fear that he will harm her son. What can she do to rectify this situation?
