My question involves criminal law for the state of: Louisiana
I plead guilty to a DWi 3rd in April 2009. The judge didn't sentence me until October 2009. I received a 5 year probation. Between the time of pleading guilty and actually receiving my sentence I got another couple of charges, but I was arrested after my sentencing date. Can my probation officer use those new charges to violate me even though they were committed before I actually recieved my probated sentence? Shes using my arrest date, which was nov 2009, a month after i was sentenced. I thought she has to go by the date the offense was committed, not the date of arrest. The bill of information list the date the crime was committed, not when the offender was arrested. Should'n they go by that Instead?and if so my chances of having those violations inadmissible should be good?
