My question involves a child custody case from the State of: Ohio

I have custody and my ex has visitation on one night a week and every other weekend. My child is 8 years old. On numerous occassions my daughter has come home to tell me stories about temper tantrums, and other odd behavior that her 10 year old step brother has displayed.

- She wakes up in the middle of the night to find him in her room watching her.
-She states that she has to lock herself in the bathroom to change clothes because he barges into her room frequently.
-The stepbrother was suspended from school for throwing a chair at a teacher.
-The stepbrother became engaged in an altercation with another child and threw a brick at the other child's head.
-The stepbrother has run into traffic after altercations with his mother & stepfather.
-The child has put my daughter up against the wall and choked her.
-Most recently, the stepbrother took a golf club through the house and did some serious property damage, which resulted in the police being called and the child being detained in an area hospital for a mental health evaluation.

This has not all come from my 8 year old, portions of this came from the stepbrothers biological father who is seeking emergency custody because it's clear the mother cannot and does not attempt to control him. He contacted me, we've known each other for years, long before either child was born, so it's not that strange that he would contact me. We have never been anything more than acquaintances though.

When the chokiing episode happened about two years ago, I talked to my ex husband. He said they were just kids, fighting the way kids do and that he took care of it. My daughter had no bruises so I felt there wasn't much I could do. Since that time, every episode I bring up is fluffed off, he says my daughter is exaggerating or that they are just kids. Now there is a police report and a mental health evaluation that I am hoping will help my case.

The boys parents currently have 50/50 shared custody. So it's pretty difficult to tell when the boy will be with my ex husband as they do not follow a rigid schedule.

What can I do? I have an appointment with an attorney, but I want to be educated when I go there. Can we do some type of emergency action to suspend visitation until a judge can review the facts?
