    Default What Happens if You Apply for a Job While Collecting Disability Insurance

    My question involves labor and employment law for the state of: New York

    My wife had a part time (20 hrs/week) job. She developed an arthritis-like disease around Christmas and has been unable to work since then. She is currently receiving disability insurance from her employer's insurance company. Her Dr has said that she may be able to return to work at her old job for a day a week or so in July. This would require that she re-apply for this new job. My question is: can she apply for this new per diem job at the same company while collecting disability payments or does she have to wait until the insurance payments stop?

    She can APPLY while the benefits continue. But she shouldn't expect the benefits to continue once she indicates that she is able to work.

    Some disability insurance companies offer incentives and assistance to help claimants return to work. It's worth investigating.

    While true, that is generally with long term disabilty benefits. If this injury happened at Christmas, it is likely that these are still short term disabilty benefits.

    However, what benefits may still be available if she returns to work on a per diem basis will depend entirely on the terms and conditions of the policy in question.
