Default If a Relative Claims the Student as a Dependent Must He Be Declared on FAFSA Forms

My son will be graduating this year (2013)from hiogh school and we will be applying for financial aid. I'm receiving Social Security Disability and I'm married. I've gotten pretty sick at times and my husband has had to take off from work for lengthy times to care for me. During these times my brother-in-law stepped in to care for my son because it was just too difficult for us, so our son moved in with him for awhile. We didn't have the money to give my brother-in-law to care for him so we allowed him to claim him on his taxes to cover all money spent on him while in his care. My question is, do we have to show my husbands's and my brother-in-law's taxes to receive financial aid? Please any help on this matter will be greatly appreciated.

He needs to discuss the issue with the financial aid officer at the college he applied to.

What question on the FAFSA application do you believe would require this relative to be listed?

I was told that they would require my husband's tax info but he didn't claim our son on his taxes. Since he lived with my brother for several months my brother actually claimed him. But I've talked to someone from the FAFSA hotline and I was told that that didn't matter.
