    Default What is Proof of Intent to Steal

    My question involves criminal law for the state of: california
    So I intended to steal a $160 item at a retail store. I removed security tag and concealed item in a fitting room. I was going to purchase another item but got cold feet and was looking to dump the concealed item. Was approached by manager and admitted concealing the item. I returned the item but was detained and charged with burglary, pc 666 and possession of burglary tool. Should I fight the charges(I do have a petty theft 10 years ago) because I wasn't given the opportunity to put the item back? Does it hurt to get a public defender first before investing in a criminal attorney( I can't afford one now but possibly in the future) and in this case(Marin county) is there any jail alternate programs that would at least keep me from losing my job?

    You need a Criminal Defense attorney. Seriously.

    For a Public Defender, you need to prove you cannot afford a private attorney.

    You have a lot working against you: The possession of a tool to remove the security device - you planned this. You concealed - that shows intent to steal.

    Petty theft 10 years ago....intent to steal now....you really need a lawyer.
