    Default Landlord Wants a 50% Rent Increase for Switching to Month-to-Month

    My question involves landlord-tenant law in the State of: CA

    I am currently renting in SJ. My rent is about 2K, for 12 month lease. Lease is ending soon, and I would like to switch to month-to-month, because I may need to move out not too distant future. Their new offer is:
    2.1K 12 months
    3K month-to-month <--

    The difference between 12 month lease and month-to-month is huge. Is such an increase legal? As far as I am aware, unit is not in a rent controlled area. Is there anything I could do?

    But if not, no there's no restriction on how much they can increase your rent provide they give you the required notice.
    These days month-to-month rents do get quite a premium.

    Yes, such an increase is legal if your rental unit is not subject to rent control ordinances. Absent any rent control provisions, rent can be increased by any amount, at any time, with either 30 or 60 days notice as per Ca Civil COde 827: there is no limit to the increase. Your choices are to choose one of the two options offered to you at your current place or move to another rental unit.
