    Question Wrongly Accused of Punching a Stranger

    I have been accused of assault on a person i dont even know. i was walking in down the street when i happened to walk by a woman with a black eye , i glanced at her but thought nothing of it. about three minutes later a police officer grabs me and orders me to sit on the ground, terrified i ask what i had done?! he says that there is a woman that said i had punched her in the eye a couple nights ago and that they had to arrest me! so they take me to the station fingerprint me ,take my pictures, and put me in holding, and i still have no idea what is happening! so i finally get to talk to the police officer that had arrested me and asked what this woman had said, she said the that i was dating her ex-boyfriend who is 32 ( im only 17 and have no boyfriend whats so ever!!) and i was mad that they still talked so i waited in an alley behind a bar with one maybe two other females and attacked when she walked by, that i kicked and punched her in her face on friday night. i told the police officer that i was new to the city and just moved here on wednesday, and on friday night i was about an hour away from where she had said this had happened with my uncle all weekend ,which i was. and i had proof that i was there with him. so now this woman is wanting to put a restraining order on my and put me in jail!!! im in shock of the whole thing and would like some thoughts on the subject?

    Based on your assertions, you should have no problem getting your uncle as a witness as well as proving you just moved there.

    So the only proof she has is her word against yours?

    Do you know her ex-boyfriend?

    This is sad that someone can just make something up and all they have to do is point a finger and wala instant arrest,now you have to pay money out of your pocket because of a messed up justice system.

    If it is just her word against yours you would normally be sol BUT if you can prove a Alibi on the night in question and also show other holes in her story you MIGHT be ok,of course if you get off then sue her.

    A messed up justice system? Really? I understand a person’s frustration and anger when someone makes a false accusation. But, do you really believe that our justice system should just ignore a reported violent assault simply because the accuser has no verifying witnesses??? What about rapes? Very few rapes are committed in front of witnesses other than the victim. Even if there is ample evidence of the sexual act, the part about non-consent almost always is just the victim “point(ing) a finger.”

    The fact is that MANY crimes are committed under circumstances where it is just the victim’s word against the criminal’s denials. That’s why, in our “messed up justice system,” police first investigate, then a prosecutor reviews the evidence and makes a decision regarding whether to file charges, and finally a jury hears the evidence and decides guilt beyond a reasonable doubt. Is it foolproof? No. Do injustices sometimes occur? Yes. Do you have a better system? I don’t see you proposing one yet.

    As far as the OP suing her accuser…well, first she will have to have evidence that the accuser intentionally made a false accusation rather than a simple mistaken identity. After all, it would be a pretty messed up justice system if everyone who reported what they thought was a crime, but turned out to be mistaken, had to worry about being sued!
