My question involves labor and employment law for the state of: Illinois based company I live/worked in Virginia.

In May 2010 I gave in and took STD FMLA. I returned to work in September when my FMLA was running out and was met with a probation letter for reporting a sales call two weeks after the actual sales call prior to my absence. My work history and reviews had always been great but then I could do no right and documented inaccuracies in the subsequent follow up reviews and got no response from superiors. Mid December 2010 I was dismissed but was paid through mid January.

I collected unemployment until around November 2011. I applied for SSD and was approved on the first round in April 2012 for physical and mental conditions.

Can I collect the long-term disability from the employer?
