My question involves criminal law for the state of: Michigan
Drove drunk at age 19. Blew a .17. The officer was kind enough to omit the test, and even told other officers and my mother that I was never given the test at all. As such, he said the most he could charge me with was an MIP, not a DUI, since he "never tested me for alcohol use."
He dated the ticket incorrectly, and I doubt the ticket would be waived due to that, and am honestly grateful for what he did for me. I wish to just do probation and pay a fine, and hope that it is expunged from my record afterwards. They did not suspend my license as of yet. Will they suspend my license, and for how long? Also, do I plead guilty or not guilty? The breath test is not on the ticket or in the police reports. If I plead guilty, will I still only get probation and fines??
