    Default Exclusion from Section 8 Housing

    My wife has been on section 8 since sometime 2010. I tried to put myself on section 8 with her in 2012 and followed their rules I cant live with her until we get the letter saying ok.

    1. We get a letter I was making to much money (Yet I was unemployed for several years since I was in court for false charges that did get droped before this).
    2. I was an unotherised occupant (yet again my child support and billes show me living at my other adress)
    3. My background which are all dismissed a year prior to the only meeting they were willing to give us.

    We were told we had an informal hearing where we had a option to hire an attorney who could attend.

    Me, the wife and attorney we thought knew what she was doing went to the "informal hearing" and not 5 seconds later the housing supervisor the housing supervisor made it clear I will never be on public housing thanks to the charges that were dismissed and my attorney said fime were going to federal court then the housing attorney started screaming for the attorney and the housing supersior to shut up and sit down.

    In the end we were told after they verified my charges were dismissed everything will be ok and to fill out a new application and place me back on it.

    2 weeks later we get a letter saying I was still not accepted on section 8 becouse I was already living in the unit even BEFORE my wife rented it her first time. We faxed in proof I was living at another adress, bills, letters from neighbors but section 8 never seemed to respond. I asked the lawer we hired what was going on and she replied "I dont know what to do I never delt with section 8 before" which was information she never told us before we hired her.

    Now section 8 has droped my wife and the landlord is evicting her and the kids for unpaid rent. Section 8's only reason is documents from the District Clerks office saying I lived in the unit before it was even rented by the wife.

    I called the District clerk to fix the reports they refer me to the sherifs department, the sherif ask why im calling them the District Clerk dont have that information that I must be a liar and when I call the police department that did arrest me their computers are down and always ask me to call back in a few days and they will look it up again.

    Didnt mean for this to be a book just giving all the info in the shortest time I can.

    What do I do now to get back on that program?

    Forgot to add was arrested for not showing up at a child support court hearing and got a letter from my lawyer saying not to go it was handled. Well it was not handled and got arrested at the wifes since it was her birthday but after we seen the judge and he seen the letter telling me my attorney told me not to go he released me. And no was not living with wife at that time.

    From what you are stating, it appears that the exclusion is based upon your using your wife's address as your place of residence for child support proceedings. The police didn't go on a manhunt to pick you up on that child support warrant - they would have gone to the address of record you provided to the court.

    My adress listed was my mother's house where I was at the time. The constables did show up to get me their but my attorney talked them down from picking me up to give them more time to go before the judge and have the warrant removed. How and why they mangaged to get me at the wifes house is a mystery unless my brother in law knew I was going to be their on her birthday or because I called the courthouse from her phone seeing if the warrant was droped yet. I even asked them but they refused to tell me. Cold also be the mother of the child works some position at the county court house and took a lucky guess and I was their I dont know.

    But that dosent answer how/why does the district clerk show me living in her hourse a year before she even rented it when old police reports show me living at the correct adress back then.

    Have I ever called my wifes place mine? NO
    Has court orders ever changed from prior adresses? NO

    There are no mysteries. The facts are out there, somewhere.

    We are not in a position to investigate court records or to explain them to you. You have not told us what court record shows you living at your wife's address a year before she moved in, nor would we have any way to determine how that information made it into that record or for what purpose.

    By your own admission you were an unauthorized occupant and are thus denied. We aren't here to find a way for you to lie to obtain gov't services. In fact, if you continue down this road, you may end up in Club Fed with your wife. I suggest you get a job and pay for your own apartment.

    I don't know if section 8 has the same rules but welfare in NY must allow you access to your case records, find out if something similar applies to section 8 so you can see what documents they have that show you were living at that address?


    did you help your wife get utilities on in your name at that address?

    No the brother in law payed the deposit, All bills are in her name. I payed her bills a few times off my credit card but its adress is my home adress not hers.

    Section 8 only had 1 record right showing I was picked up for failure to appear on her birthday but no other links.

    At the informal hearing all they had was records from the district clerk... arrested at her house on her birthday ok but that dosent mean I lived their.

    And again the classic how can the police department change all my records before she even rented the house saying I was already their then.

    I simply guess nobody can tell me or knows

    How common is it for a married couple not to live together?

    Is it not a natural assumption?

    The charges I had at the time included domestic abuse to her and no contact with any child at the time, so even if we wanted to be together it was a violation of bond probation.

    Not only that but I found out a few months after we were married I was never divorced from the first wife like I was told I was. I had my layer swear it was done he had the fnal but somewhere somehow during all these new charges on me at the time their was a court date for the divorce I missed so it was not officially over at that time. It did end.

    Section 8 asked my wife at the time questions like this and why she never notified them, they assumed she was single.

    But in the end, after the hearing we got a letter 2 weeks later all was fine except I was again living their before she even rented the place. I was never living their I was told not to unless section 8 said it was clear. District clerk says my 4 criminal arrest all had her house as where I was arrsted and living but my old bond paperwork says my real house I was living as well as my probation papers and everything else.

    So the District Clerk is reporting a false adress on 4 cases that leads to the family getting kicked off section 8 when its the county itself reporting them wrong.

    You may just find that your criminal history precludes you from Section 8 anyway.
