    Unhappy Is it Foolish to Disclose an Expunged Criminal Record in a Background Check

    My question involves criminal records for the state of: Colorado
    I have an expunged record from a domestic dispute that took place about 7 years ago. It was originally a misdemeanor, then completely dismissed after a probationary period. (original charge was domestic violence misdemeanor, then infraction, then dropped). I was able to have it expunged with a lawyer's help and it is not on my CBI report. There is nothing on my CBI report - no arrest record, nothing. I am having an extensive background check done for a job in a corporate travel agency, and today I had an interview with the investigator. He asked me if I had ever had an expunged record. I admitted that I did and told him the information pertaining to the incident, expungement, etc. I told him in fear that he already knew. They are a huge travel organization that also does the hiring of pilots and flight personnel. I told him in fear that he probably had some sort of federal clearance to find out anyway. Did I do the right thing by telling him or was I foolish? I am worried that I blew it now and they will not hire me with this information.

    Some employers are entitled to ask about expunged records, although Colorado has fewer exceptions than most states; travel agencies... not so much.

    Is this employer based in Colorado? Per statute,
    Quote Quoting C.R.S. 24-72-308(f)(1). Sealing of arrest and criminal records other than convictions.
    Employers, educational institutions, state and local government agencies, officials, and employees shall not, in any application or interview or in any other way, require an applicant to disclose any information contained in sealed records. An applicant need not, in answer to any question concerning arrest and criminal records information that has been sealed, include a reference to or information concerning such sealed information and may state that no such action has ever occurred. Such an application may not be denied solely because of the applicant's refusal to disclose arrest and criminal records information that has been sealed.

    It is a national based company, but is for a job in Colorado. Some other inappropriate questions were also asked during the interview that I really don't want to elaborate on at this time. I actually feel somewhat violated. I don't know about the job yet. I have decided either way I am going to do something about it. Thank you for your response.
