    Question Ohio Step Parent Rights

    My question involves a child custody case from the State of: Ohio

    Do I have any rights as a step-parent? We have a very complicated mess. My husband and his ex have shared parenting. However, the ex wife is considered residential parent for school placement only.

    Originally my husband was supposed to have custody per the parenting scheduled of every weekend and every Wednesday night - but Ohio just switched from paper filing to e-filing and when they were at the help desk at the court even they weren't sure how to complete the paperwork and by the time they left court he only has custody on paper for every other weekend and no Wednesdays.

    That being said - we have his daughter about 80-90 percent of the time. The last time mom had her was overnight on January 27th and because of an argument she also had her January 29th which was abnormal.

    She is in out home a minimum of 80% of the time. Typically mom will have her on Thursday nights at about 8pm until she goes to school the next day and that's about it.

    Mom moved without notifying the courts. She moved to another county (about an hour drive). The daughter goes to a charter school and so she is still able to attend.

    However, since she is with us 80-90% of the time when she has an issue and needs to leave school , go to the doctor/dentist/etc that falls on me and her father.

    The school has no problem calling her dad to tell her she needs to go home and they will let me come and pick her up. I can pretty much sign her out of school any time I want. However, I can't call and ask that they send homework home, find out how many days, she has missed, etc.

    The school said that mom has to give permission for them to give me any information. Dad tried to give me permission but they wouldn't. I have asked mom to call and give permission for me to be able to find out about her school stuff but I don't think she will ever get around to doing it. It's like pulling teeth for her to just call her own daughter.

    Do I have any right as a step-parent in Ohio or does dad have any right has the biological parent to make the school release information to me?

    It's so frustrating!!!

    Nope. And as long as Mom refuses to allow you to be given information, you don't get information. In shared custody agreements, both parents need to consent to the release of information.

    However, I can't call and ask that they send homework home, find out how many days, she has missed, etc.
    Then Dad needs to take five seconds out of his day and do that.

    I agree. Its his child. He needs to take the time to do it himself.

    Many OH schools have assignments/grades online. You can check everything from home. See if they do and dad can get an account.
