    Default Do I Have to Acknowledge Discipline at Work

    My question involves employment and labor law for the state of: New York

    So I posted earlier about my exemption status.

    I asked my employer about my entitlement to overtime I thought I was entitled to. They told me that I wasn't and the next day called me into a performance concern meeting. In this meeting they told me there were complaints about my performance and asked me to sign a paper co Sebring to such. I told them I would sign at a later date.

    My questions are:
    1) do I have to sign the warning?
    2) what are the consequences if i refuse?
    3) is this retaliatory?

    1.) No, you do not have to. But if what you're asking is, is your job protected if you refuse, the answer is that it is not.
    2.) That's for your employer to say.
    3.) Quite possibly. But not all or even most retaliation is illegal, and there is not enough information here to judge whether it's the legal or the illegal kind.

    I think you need to ask them to prof that the complaint against your performance. Before read all conditions and after sign effect please do not sign. Best of luck....

    OP if you follow ket80's advice you may get fired, and said firing would be perfectly legal.
