    Default When Does it Help to Hire an Accident Reconstruction Expert

    My question involves an injury that occurred in the state of: CA

    I was in an accident. I was going over an over pass going 30 (speed limit). In the middle of three lanes. I was rear ended. The car behind me hit my left rear corner of my car with the right front corner of his car. Although the two car hit in the corner I was a hit from behind (not the side impact). My guess is that this car was trying to pass me or tried to avoid hitting me by going to the left.

    The problem is they claim I was changing lanes (I learned about his a day after the accident when contacted my insurance company). I was not. The police refused to file a report they said they don't file report unless there need to be an ambulance.

    The previous I have posted before. But I have other questions.

    My insurance refused to file a claim on my behave because I only have liability. And the other insurance company have denied my claimed.

    So question is would it help with my claim and if my claimed continues to be denied to hire a Collision Reconstruction Firm. Look at the damages to my vehicle I a pretty sure that a Collision reconstruction Firm can show at least although it was corner to corner that I was hit from behind coming from behind (no to the side).

    But since it is still their word against mine will it help to have essentially an expert witness to say I was hit from behind from the back to front direction.

    You mean, if you file a lawsuit and bring in an expert witness to testify based upon records and photographs of the accident location and damage how he believes the accident occurred? That may help in a lawsuit, but it would also be expensive.

    If you mean, will it help to pay for an expert opinion and report to provide to the other driver's insurance adjuster? It will depend on the adjuster, the amount of evidence available, and how convincing the report turns out to be.

    I agree with aaron's assessment but would like to also add that unless you were able to see/find a reasonable amount of tire markings and were able to document those with photos or the collision resulted in some broken part that were found whose location was documented immediately after the collision, then the amount and scope of damage on both vehicles is not likely to provide conclusive evidence as to exactly what happened.

    What you can do as a last ditch effort, is to file a complaint with the California department of Insurance. They will re-investigate all available fact of the claim and provide you with an impartial unbiased conclusion. I think that would probably be your best course of action.
