we made in last June involving our daughter who is 16 months My question involves a child custody case from the State of California.wondering how I go about modifying my ex and my current court ordered visitation agreement old and is walking and talking more amd more everyday.We both have joint legal and physical custody of as of now . Also she has a 14 year old daughtyer and 10 year old son from a previous marriage and since we split up they are staying with her father with all three children . With her 14 year old daughter getting her own room her 10 year old son having his own room and father staying in the master bedroom. Which left her and our daughter to share a small "converted" living room/ bedroom that doesnt even have a door on it mind you that is her and my daughters sleeping quarters. The father of her two other children is not involved at all with his son or daughter.
I live by myself in a nice spacious one bedroom one bath single level apt, I am employed, own my own vehicle and have been at my current residence for the last nine months, As it currently stands I only get to see my daughgter every other weekend Friday through Sunday giving my daughter and I six days of visitation a month. I have been checking around a few of the different day cares in the area to enroll my daughter in during the times I will be working which is usually Monday through Friday 7:00am to 3:30 pm What I am wanting is to change current order to 50/50 in which we would trade off every two weeks or every other week. My daughter and myself have built and are continuing to build a strong bond over these past 16 months and can see it effect her when she leaves on that sunday night every other weekend. My ex does not want to change curret agreement which is mainly due to her not wanting to put her personal feelings aside in realizing that it is in the best interest of our daughter to have equal time between each parent and realizing that equal time with each parent is the healthiest situation for our child in her early developmental skills.
