    Default Getting Married with J1 Visa

    Hi there,
    7 months ago I came to US with J1 visa and I met my husband there, after 4 months we got married together, my visa was valid just for 3 months (but with J1 visa we can stay in US one month more) It means my visa date was expired in my passport when I got married. My husband is an American citizenship, and after 3 months we got married , we wanna apply for green card for me. But I'm so scared because at first my visa has been expired and also my husband is 20years older than me. but we have so many pictures, so many things can prove we live together. Do you think , these problems which I said earlier can make a problem for us to get the green card? Do you think we need to hire a lawyer to help us? ( because in opinion we don't need a lawyer, we know each other and our marriage based on live together until death do apart)

    It sounds like you were exchanging more than culture in the US and committed fraud according to the terms of your visa. I suggest you go home and file from there.

    If you don't want to petition to adjust your status, pack your bags and return to your nation of origin.

    Are you stating that you came to the U.S. with a J1 visa naming a fiancé, and within four months had broken up with your fiancé and met and married somebody else?

    I came to USA with j1 visa, to work here for a short time.after awhile I met my husband and we got married after
    4 months. I didn't say I came USA with k1 visa which is for fiance.

    I'm sorry.... my brain misfired. For some reason I was reading "K1" instead of "J1". Totally different thing....

    The first question, then, is whether you are subject to the two-year home residency requirement. If so, you cannot adjust your status unless you fulfill that obligation or secure a waiver. If not, then you're eligible to adjust your status based on marriage.

    The second question, and you're right - it's a biggie - is whether the USCIS is going to view the marriage as bona fide, or if they're going to suspect either that you had a prior relationship and entered under false pretenses, or the marriage is a sham and your primary goal is to get a Green Card. With the age difference, the brief premarital relationship and rapid marriage, and your overstay prior to the marriage and continuing afterward, there are plenty of reasons why the USCIS will be skeptical of the marriage. I do think it's advisable to discuss the full facts and the evidence you plan to submit as proof of your relationship with an immigration lawyer.
