    Default Father Wants to Pay Less Support, Right of First Refusal

    My question involves child support in the State of: Ga
    Hi new to the forum.I live in Ga and will try to make this as brief as possible. My ex whom i briefly dated before getting pregnant ( mistake 1 not the baby) has literally done everything he could to make my life hell to get out of child support. Got me fired from a job, sends me pictures of girls hes dating,records video of me.emails and texts all the time.In april he got tired of me telling him not to party,quit laying out of work,help with the house and so on.He called me at work and told me i needed to move or he would get an apt below me ( locking me into a lease with an infant that i surely couldnt afford) so I did what was needed I moved that day after getting him to take over lease and being removed from responsibility.I am not perfect but I am a hardworker,keep a clean house,and very responsible.I moved in with my 74 yr old grandmother who adores my child who is now 17 months old.She keeps my daughter for 75 dollars a week and i pay 400 dollars a month rent along with 100 dollars towards electricity and the water bill.I also have two children one who is 19 and the other is 15 and i pay their dad around 400 dollars a month as well as school clothes,entire christmas,as well as many extras when possible.I tried getting along with my daughters father simply because he is her dad, a few weeks after splitting up I took interest in a drop dead gorgeous guy and even though i didnt have him around her her father found out and went to my job and made some nasty accusations and got me fired from my job.My next move was then 2 take out a temporary order to keep him from trying to ruin my life any further.The judge issued a tpo with 100 dollars a week child support.needless to say he never paid.The judge we then went in front of told me to go to child support enforcement and issued no visitation until paternity was established even though he sighned the paternity affadavit.So from may -august no money no anything.I did the whole cse thing.He got an attorney because he felt like his 702 a month cs was gonna be too much.I got another job making 3.00 less an hour and I got an attorney.At our temporary hearing the judge was livid when hearing everything.He told him he would cut him down after reading the racial slurred emails,about my firing,and his making up crazy things.He was ordered to pay 815 a month cs,1/2 medical bills, and pending final court my attorney fees.A restraining order was issued and he still emails and texts all the time,reduced his hours at work ,put in for a modification, doesnt pay his cs like hes supposed to, and wants right to first refusal so the child care expense from my grandmother wont be figured in the final order..... I just wanted an expert opinion will the judge see through this and is my working overtime because i have to to take care of my kids gonna hurt me.

    Which means you and your lawyer have initiated contempt proceedings for the protective order violations, right? If not, what are you waiting for?

    If you establish that he voluntarily reduced his hours, the court won't find that to be a valid basis for a downward modification. Discuss it with your lawyer.

    The problem with that being what?

    I find it difficult to believe that there is no overlap in your work schedules.

    This is a support modification issue. If you are stating that you have increased your income, your current income can be applied to the calculation of support.

    thanks for answering his keeping her would not be a problem at all if he was like my boys dad responsible .. i have offered to let him keep her he says he will then doesnt show up. I wish I could just tell him to not worry about helping but right now i dont have that luxury. My lawyer seems like most doctors or lawyers or other busy people he tells me to keep everything and when we go for final hearing we will present it then.He is a good guy i like him.Oh I forgot something important... Hes a convicted felon.Selling drugs police showed up as I went into labor to pick him up.Had no clue what he wa doing I begged him to stay home i thought he was cheating.Guess not
