    Default Credit Card Company is Harassing Me

    My question involves collection proceedings in the State of: Florida

    Sorry, I am not even sure if I am posting this in the right place. I have a credit card that I forgot to make a payment on in December. Well, in January, I pretty much got bombarded by them for my $25 payment! Between the 17th-27th I can record that I have received over 50 phone calls from them that is not including the previous 4 weeks before that. I am all caught up, and now they are calling every day and basically bullying me to make my monthly payment NOW and over the phone. I asked her to please note I do not want to receive phone calls from them anymore and she told me they can't do that.

    Is there anything I can do? I have been blocking numbers but as soon as I block the number they have a new one calling. Obviously this is getting paid off as soon as possible & cancelling the card but I don't feel like this going on until I can do so. Thanks!

    In Florida, the Fair Debt Collection Act allows creditors to call you every day, between the hours of 8 am and 9 pm. While the law doesn't spell out how many calls becomes "harassing", case law in FL and many other states has found 7 to be allowable (in fact, most collection agencies have their phone auto-dialers set to call you up to this many times, then stop for the day). That's only IF they don't speak to you. Once they actually make contact with you, they don't get to call again that day. At 8 am the next morning, you're fair game for calls again UNLESS you have given them notice to the contrary (for example you work nights and prefer your calls in the evening). If they are calling your cell phone, the law allows you to notify them - better do it in writing - that the number they are calling is a cell phone, and if you request no further contact at that number, they must comply with that request. If it's not a cell phone, they get to continue to call to pursue the debt. Flip side is that if that's the only number they have for you, this equates to you cutting them off from phone collections, which can cause your case to be escalated to collections via being sued in court (if you won't talk to them any more, they have nowhere else to go but court to resolve the issue).

    Thanks! That is just the thing though, I don't owe then anything, so I don't see why they are calling.
