    Default Advice with Moving Out of State

    My question involves a child custody case from the State of: WA

    Hi,

    I am the father of a beautiful 2 year old boy, after the first week of my son being born his mother left the residence to "do her own thing" ever since that time i have been in custody of my son. After about 4 months of her not seeing him, she brought me into court trying to take custody of my son and enforce child support upon me, obviously the judge through her request out but did allow her visitations every day of the week. after the next 2 years of going to court for her not showing up to see my son and other things she was caught doing that were not on the up and up, the judge lowered her time to an hour and a half every other day and let her have every other weekend with him. I wish to move my son down to CA where i have been offered a better paying job, and where i think he would have a better experience of life growing up however his mother is spiteful and will not allow him to leave the state not because she thinks its better for my son but because she wishes to punish me, i know this to be true because even though she has such little time allowed today she still does not come to see him for example these last two weeks she has only seen him once for an hour and a half and has not taken her weekend time allowed (this is a regular occurrence, not just these two weeks).

    my question is, is there any way to get permission from the court to move my son and myself out of state without her consent, and if so how would i go about doing so?

    WA is currently "moveaway friendly" - the burden of proof is on the non-relocating parent to show why the move is not in the best interest of the child.

    You'd be best off speaking with an attorney.

    the only problem i have with wanting to go and spend the money on an attorney is, i thought the only proof she has to show is that she "wants" to be in my sons life?

    No, that's not the case.

    She can still be heavily involved in your mutual child's life.
