    Default Paternal Rights of Child Seeking Divorce

    My question involves a child custody case from the State of: Florida

    I am a father of a 1 year old who I was NOT married to the mother when the child was born. My name is on the birth certificate and we have since married but I am now seeking a divorce. We are currently living together.

    There is currently no court ordered paternity in place but since we are currently married and I am on the birth certificate do I need to have this done.

    Do I have the right to take the child with me when I move to my new home in the same state and county? (Florida-Lee County)

    If you're on the child's birth certificate, you're the child's legal father.

    You should discuss your plans with your divorce lawyer before surprising mom by disappearing with the child.
