    Default How to Sue for Back Child Support when Ex Lives in a Different State

    My question involves child support in the State of: Georgia

    I have 2 children, ages 24 and 22. my 24 year old was emancipated when she finished school, my Ex ( he lives in NJ not GA) is paying child support to my youngest while she is still in school. About $16 of what he pays her each month is back child support. He is currently $8000 in arrears.

    My youngest will graduate next year from school and the payments will stop. My question is how do I go about suing him for the $8000, or can i even do it.

    My fear is that she will graduate and he will emancipate her (as he did with our oldest) and we will never be able to collect the back child support once he is not obligated to pay.

    Im looking for information on how to start the process of suing him for the arrears. Him living in a different state is what concerns me most.

    You can attempt to enforce the judgment through the court that issued it. If the support order was issued in Georgia and you prefer to try to collect the money yourself, you will need to domesticate the judgment in New Jersey (usually a pretty simple process) then employ judicial remedies (creditor's exam; execution and/or garnishment against non-exempt income and assets) to collect the money.

    When he files a motion to emancipate the younger, you can file a counter motion (and show up for court) for him to have to continue paying the current child support rate until the arrears are all caught up.
