    Default Ticket is "Not in the System"

    My question involves a traffic ticket from the state of VIRGINIA:

    My wife got a legit speeding ticket about 3 weeks ago in Chesterfield County VA. We were going to prepay it and when she calls they say "Its not in the system". When I go to look it up online using both her name, or the ticket number, or the date of court appearance it doesn't show up, either. My wife is wanting to aggressively pursue it and is afraid she'll get tagged at some point down the road in the future because of it. I say 'let sleeping dogs lie' and if its not posted up or the court never has it in the system, then it was probably human error in not submitting/entering it and it never will show up. She feels she needs to write a letter about it and trace it down.

    What say ye? Anyone have any experience with this occurring? TIA.

    If she was given a citation then there is a great likelihood that she signed it making a promise to appear, or the citation was served upon her and therefore constitutes an order to appear on the date indicated... etc. And so no matter how you spin it, it is her responsibility to appear as promised or as ordered.

    Those sleeping dogs you let lie, will likely wake back up at some point when you least expected; more often than not when it is least convenient. And when the do wake up, they WILL bite.... Your wife is on the right track. She needs to contact the court to inquire about what to do next.

    What exactly was she cited for (it will be something like 46.2-xxx)?

    Section 46.2-570 : Speeding 71 in a 55

    The mystery continues. Not in the on-line docket to pre-pay and when we call the Clerk's Office they say 'We can't do anything until its in the system'. A perfect Catch-22.

    Ticket issue date 1-12-13
    Notice to appear date 3-28-13

    Guess we'll just have to keep checking, its still 7 weeks out.

    Plead not guilty and at court file a motion to dismiss - lack of jurisdiction -- they can either produce the ticket or they cannot. If they cannot, a dismissal is in order (do not bring your ticket there and don't be bullied by the court - demand that THEY show that the court has jurisdiction--its their burden, not yours to show they don't).

    Also be prepared to lose such a motion .. ie be ready for trial.
