    Exclamation Can a Sixteen Year Old Pick Which Parent to Live With

    My question involves guardianship in the State of: West Virginia
    I live with my mother and have since my parents divorced when I was a year old. I get visitations with my dad every other Saturday from 9am-8pm. While I was at my dad's yesterday my mom searched my room and found belly button rings that I had bought since my dad allowed me to get the piercing as an early Christmas present over a year ago. When I got home she took away my phone, computer, all my other electronic devices, and all my piercings. She's taken away everything my dad has gotten me. My stepdad told me he didn't like the piercings, therefor I cannot have them until I move out. I want to live with my dad but not until summer so I wouldn't have to change schools so he suggested I live with his parents who are closer to my current school and they could drive me. Is there any legal way to do this without my mother's consent? And also my best friend's parents said it would be okay for me to live with them until the school year is out. Would that be possible?

    JamieDawn, your Mom is basically being..a parent. Until you're 18 you're under the care and control of your parents. The fact that Dad appeared to do this without Mom's consent is not a good thing.

    You don't have standing to do anything, and Dad would need a major change of circumstance in order to change custody.

    There's absolutely no way you're moving in with your friend's parents, or your grandparents, unless both of your parents agree.

    If your mom has custody of you and you are under 18, you can't live ANYWHERE else unless she consents.
