    Default Probation violation in Ohio, Lake county

    My daughter was severving a 30 day sentence for a F4 drug charge. Three inmates found out that she was on pain killers for a dental problem, they cornered her in her cell and told her that she had to bring them some in when she came back from work the next day or they would hurt her. She has never been in trouble before this 30 day sentence and was scared to death of jail, so she got so scared that she brought them in 2 pills the next day. Someone reported seeing the girls crushing something up and an investagation took place. One of the girls ratted out my daughter. My daughter was too trusting of the detectives and they told that she would be charged no matter what...so she spilled her guts.She didn't have a Lawyer present for her statement. She is now being charged with a F3 conveying drugs of abuse into a detention faucility. Meanwhile since what she did was a Probation Violation she is still in jail. She was due to be released 25 days ago from the first charge. The lawyer we HAD said that at her probation violation hearing that the judge wanted to give her a yr in prison for the both charges, F3 and PV , we refused it,and he put in for a continuance and we haven't heard about a new court date yet. Does this mean he can give her more time when the indictment comes down since she didn't agree to the first deal? Mean while the indictment hasn't come down yet, but yet the judge hasn't sentened her for the PV. How long can he hold her and can't he just sentence her for the PV and then just wait for the indictment for the F3? How much time can he give her for the PV? In her original sentence, he didn't leave any time over her head. Just 2 years Community Controlled Probation.
    Is it possible for the judge to give her house arrest for the PV. Help!!!!
    I plan on hiring another Lawyer but until then I have these questions. Can you please help?

    How old is your daughter? I have to agree that fear can cause people to do stupid things. Like myself i let fear get the best of me. however be careful about coming to your daughters rescue so much. If you keep doing that she will become dependant on you....and she will be expecting you to get her out of trouble all the time. You will also be exhausting yourself financially. Bringing drugs into a prison system is very serious and the judicial system all work together and show each other favor. The prison is part of the judicial system. Your daughter could have told someone in jail and they would have moved her to another cell. but instead she brought drugs in. i know you love your daughter but she is going to have to learn sometimes

    My daughter is 22. She knows now that she should have told someone. But she was so scared with this being her first offense that she didn't think or know who she could trust. She realizes her mistake and regrets every second of it now. She says that she wishes that she would have just took a chance of them beating her up for not bringing in what they wanted. but what is done is done and nothing will change that. The hardest part of all of this for her is that she has 2 children 2 and 5 yrs that she misses so much that it is all the harder for her to be away from them. I am all my daughter has and I will always stand by her. I know and she knows that she did wrong and now has to pay for it. I just hope that they can keep her in the County and not put her in Marysville. I fear for her mental state if she goes there. She is very scared of the things that she hears takes place in prison and I know that with the way she cries all the time about missing her kids that she will be an easy target. What do you think her chances are of staying in the county? The indictment still hasn't come down and the time that she is in there I hope will go for as credit for time served. so far she has been in there a total of 55 days that is counting the 30 days of her original sentence. Any information I can receive about all of this is very helpful and I apprecialte it. Helps for me to have someone to talk to about this. I have thought about joining asupport group myself but I am lucky to have the time to sleep with being on third shift and taking care of the children during the day. I can't afford child care so I am dealing with this whole thing alone.

    Your love for your daughter shines through. I can't tell you exactly what is going to happen. But there is nothing wrong with prayer! it can be a powerful thing in times of trial. tell your daughter to get active while she is in jail. take some parenting,counseling courses, or if she has not got her diploma obtain a G.E.D. jail offers these services. this would help her case. judges like to see inmates doing something positive instead of just sitting in jail not doing a thing. When i was in jail Jehovah's witnessess would come and offer bible studies. i would go and learned a great deal about living a moral life. they can offer you free home bible study also just check in your local phone book. The positive thing about this is her kids are safe and in good hands. other women in jail have their kids in foster homes because there was no one to take care of them on the outside. so really jail can help her to re evaulate her life. and the values she will hand down too her kids from this experience will be worth more than gold itself.

    The time your daughter spends in jail will count towards any sentence they give her. when i was in jail. i use to see people get into fights over playing cards,board games,and television. if you lose a card game then some inmates would expect you to give up your lunch or dinner too them. so tell her to be careful getting involved in recreational activities while she is in there your daughter will probably get to know some people in jail. usually whatever her personality is like. that's the kind of people she will draw close too. believe it or not there is good influences everywhere you go. if she gets busy in the things i mentioned in my previous posts she will find positive inmates striving to do the same thing. about her getting beat up. no one should take a beating. it's unneccessary and she could sue the jail system if they failed to protect her from serious injury.

    Thanks for responding. My daughter is tring to get her G.E.D. but they told her that since she has a case pending that she is being denied studying for her G.E.D. and I think that is a bunch of crap and isn't right. She does attend everything that they offer, which boils down to church, AA meeting and N.A. meetings. Some of the inmates were so worried about her and the way she cries all the time, they put in a request for a Priest to come visit her and he did. She says that she reads the bible alot and reads as many books as she can get her hands on. She did say that there is a lot of drama in there and she tries to keep to herself as much as possible. I hired a Attorney for her and hopefully that will help. He says that the longer she is in there before the indictment comes down, the better off she is for when they go in front of the judge again. Do you think it is possible that they will or can give her house arrest for something like this. What other types of programs or stuff is there to recommend to the judge in place of prison. She doesn't belong in prison. And I am not saying that because I am her mother. her probation officer had told her once before that she didn't want my daughter to go to prison and suggested some type of rehab program called Neo Cap. Have you ever heard of this program and what exactly is it? Do you think it would help or hurt at all for me to talk to her probation officer about my daughter? I know my daughter needs punished for what she did and she has been. Being away from her children is the biggest punishment for her. She told me today that after she has been in jail for 60 days then one of her children can come see her for 15 min a week. I explained this to my grandson, (age 5) and how the visit will be and he seems to understand, I know it will be hard on him and her but at least they will be able to see each other and know that both are OK. Have you ever heard of an inmate being released for so many hours on Xmas day to spend time with their children?     House arrest sounds like a winner. I hope you can get that attorney to push that. i never heard of neo-cap there could be different programs for different states. and i have seen inmates get permission to leave jail for different occassions. but not xmas. the special permission i am talking about is the death of a close relative like a mother or father. i have seen people leave to go too the funeral but they were accompanied by corrections officers. xmas would'nt be something they would release her for....one reason is on holiday celebrations people will serve alcoholic beverages. and by the way you say your daughter cries. i can see her taking full advantage of the booze. and that will only increase the problem

    Hey thanks for that NEO CAP information. That place sounds like a better place then prison and closer to home too. Thanks. I will let her know about this program, it may be something for her to see if her Attorney can try to get for her if the other alternative is Prison.

    As for my daughter drinking, she isn't a drinker and neither is her family. Some people think that the holidays are a time for drinking where as our family looks at the holidays as a time to be with loved ones and celebrate life by being together.
