    Default Friend Borrowed Car Without Permission, then Wrecked It

    My question involves an incedent that occured in virginia. My friend borrowed car while i was asleep to go pick up some girls, without my permission. He brought them over and on his way taking them home he totalled my car. He came back and woke me up and explained the situation. I then rode the scene as my car was being towed away, i sat in the cop car and was breathilized, we'd all been drinking. I come back to the house with the cop and he talks to my friend and decides to only charge him with driving without a license and failure to stop at a stop sign. (No alcohol charges and he admitted to drinking) the cop said he didn't believe the wreck was alcohol related. And didn't charge him with grand theft auto because it was my buddy. Now a few days later he's been a real wise ass to me saying i want too much for the car when i'm going by 3 different car value sites and am rounding down. I have liability insurance and i'm worried he wont pay up or give me an equal replacement for the vehicle. Do i have any legal leverage here? Can i charge him with grand theft auto even though the cop chose not to? We're both below the age of 21 but neither of us are minors. He has a learners permit.

    did you tell the cop your friend stole your car or borrowed your car? If the latter, friend didn't steal it.

    If your friend won't pay you for the damage he caused, you will likely have to sue him. If the vehicle is worth less than $5000, you can use small claims court. If you are awarded a judgment, you still have to collect on the judgment.

    I told him he took it out without my consent. Can i charge him?

    contact the police department and tell them you wish to press charges

    I suspect whatever the OP told the police led the police to believe that although it may have not been with prior permission, there was no reason to believe a crime had been committed. If so, chances are the DA is not going to pick this up and file charges.

    A true friend would not borrow a car without permission.

    Get a lawyer. Explain why you did not file the charge to begin with.
