My question involves criminal law for the state of: New York
I was stopped this week in front of my place of work. Me and a co-worker entered the car i was using to place a call to our employer when an unmarked police car parked right next to us and asked to roll down our windows so we did. They asked for our id's and at this time i noticed that on the way to work i had forgotten it at home and told them about it. They thought we didn't work at the said address but the manager of that said address was out and in plain view, i asked the officer to confirm it with them and they said they aren't going to bother. They asked if any drugs or weapons are in the car which i replied no and at this time they had us step out of the vehicle as we were placed directly behind the car and held as the partner started searching the vehicle. She found nothing and at this point i noticed she wanted to go through my glove compartment which i told her partner that i did not consent to a search and they got in my face and shouted, cursing that "they didn't need my ****ing permission" and kept saying 4th amendment. The cop searched the glove compartment and found nun chucks which didn't belong to me personally as a family member owned the car. We were arrested after she found it and brought back to the precinct where a full inventory was conducted in the trunk. I asked them for several hours why we were stopped but they kept saying that they didn't need to tell us until the day at court but before release they told my co-worker that they saw him around the work place a few times before and they had drug busts happen in that area in the past. She never saw me in the area before so she thought he was selling something to me.
- Huge parking lot, lots of stores no way they could of spotted us from a far distance as we only exited the work place for one minute to place the call.
- we were on our phones as they approached the car
- told to get out and searched without giving an exact reason
- went through the glove compartment after telling them i gave no consent to search, got in my face and yelled, cursed, acted like total idiots
- claims i was beligerant, i remained calm and asked why i was stopped and they didn't have my permission to check the glove box.
- found the item in the glove compartment and arrested us right after
charged with 265.01
are they in the wrong?
