    Default If You Marry Using a Fake Name and ID, Is Your Marriage Valid

    My question involves marriage law for the State of: California

    Some years ago I left my family because they were criminals. I obtained a false ID and have studied and worked under it with no problems until now. I met a great girl and we want to marry. She knows my history, but we're both worried that we won't be married legally if I use my false name for the license. What's the true position, please?

    You have to use your legal name.

    Well Mr. Corleone, why don't you change your name legally? I doubt at this point your family gives 2 flips about you, unless we are talking about The Family. Then they might, especially if you are hiding because you dropped the dime on them.

    They were minor criminals but I didn't like what they did. Thanks for the reply, anyhow. I guess they have no way to trace me if I change my name legally. I wasn't sure, is all.

    Yeah, I don't think "my family are minor criminals who might, possibly decide at some point to look for me" is going to convince a judge to seal the record on that one.

    OP, do you have any reason to think they are even interested in finding you? I mean, why would they?

    My older brothers (and my sister) have strong views on family loyalty. Now someone says a legal name change can be found out easily. How does that work? I don't like to approach the authorities until I know where this is going. It's easy to be relaxed when it's not your life at stake...

    The drama llama followed you home, huh? Don't feed it, maybe it will go away. You're acting like they're going to murder you in your sleep.

    Legal name changes are a matter of public record, which means that anyone can go down to the courthouse and inquire. Generally, one must also publish a notice of name change in your city's paper of record. Legal notices typically are published in the classifieds.

    Unless your family reads the classifieds or regularly inquires at the courthouse, there's little to be concerned about. And even if they DO track you down, you handle it by telling them to leave you the hell alone, or you'll file for a restraining order.
