My question involves a mortgage in the state of: FLORIDA
I have a home that was awarded to my ex husband in our divorce, for convience purposes at that time we agreed to leave the mortgage in my name, however the deed to the house remained in his name, as he was to assume the mortgage at a later date. None of that happened. Afew years ago he lost his job, thus the mortgage fell behind and is now in foreclosure, of which is affecting me and my credit, but not him because he is not on the loan. However he as of today lives in the home. I am now trying to sell the home or figure out what to do. He is working now, but has decided that he doesnt want the home,but has not moved out so that i can try and sell if or apply for a modification and possibly rent the home out. I have asked him to sign the deed over to me,but he has declined. I just want the loan out of name, or can i force him to move? Does he have any obligation to the loan?
